Celergate Open Banking Terms of Use

1. Introduction

These Terms apply specifically to open banking services made available through the Celergate platform.

Open banking services allow you to securely connect your bank account to Celergate in order to:

  • access account information, and/or
  • initiate payments directly from your bank account

These services are provided in partnership with regulated third-party providers.

2. Definitions

"Open Banking" means the secure sharing of financial data and/or initiation of payments through authorised third-party providers under applicable regulations.

"AIS" (Account Information Services) means services that allow access to your bank account data.

"PIS" (Payment Initiation Services) means services that allow initiation of payments from your bank account.

"TPP" (Third-Party Provider) means a regulated entity that provides open banking connectivity services.

"Partner Provider" means the TPP engaged by Celergate to enable open banking functionality.

"User", "you", or "your" means any individual or business using Celergate's open banking services.

3. Nature of the Service

Celergate is not a bank, does not hold customer funds, and does not provide banking services.

Open banking services are enabled through regulated Partner Providers. Celergate acts as a technology platform that facilitates access to these services.

4. Eligibility

To use open banking services, you must:

  • be at least 18 years old
  • have a valid bank account with a supported financial institution
  • have authority to grant access to the relevant account

6. Authentication and Security

All authentication is performed via your bank using Strong Customer Authentication (SCA).

Celergate does not access or store your banking login credentials. You are responsible for maintaining the security of your device and banking access.

7. Data Access and Usage

Data accessed may include account name, account number, balance, and transaction history.

This data is used for payment processing, fraud prevention, and service improvement in accordance with our Privacy Policy.

8. Third-Party Providers

Open banking services are delivered via regulated Partner Providers.

Celergate is not responsible for their actions or service interruptions caused by them.

9. Payment Initiation

You authorise Celergate to initiate payments based on your instructions.

All payment authorisations are confirmed via your bank. Once authorised, payments may not be reversible.

10. Revocation of Access

You may withdraw your consent at any time by disconnecting your bank account or revoking access via your bank.

Revocation does not affect already authorised transactions.

11. Service Availability

Services depend on bank systems and Partner Providers.

Celergate does not guarantee uninterrupted or error-free service.

12. Liability

Celergate is not liable for failures caused by banks, errors in bank data, unauthorised access due to your negligence, or third-party provider issues.

13. Regulatory Framework

Services are provided in accordance with UK Payment Services Regulations 2017 and PSD2.

Partner Providers are authorised by relevant financial authorities.

14. Suspension or Termination

Celergate may suspend or terminate access due to legal requirements, suspected fraud, or breach of these Terms.

15. Changes to These Terms

We may update these Terms from time to time with notice where required.

16. Governing Law

These Terms are governed by the laws of England and Wales.
